These Terms & Conditions apply to purchases made through the Gabby Nind Art website. By placing an order, you agree to these terms.
About Gabby Nind Art
Gabby Nind Art is an independent art business based in the United Kingdom, selling original artwork, fine art prints and related products.

Orders
When you place an order, you will receive confirmation that your order has been received.
An order is accepted once payment has been successfully processed and the order has been confirmed. I reserve the right to cancel and refund an order in the unlikely event that an item has been listed incorrectly, is unavailable, or there has been an obvious pricing or technical error.
Original artworks are unique, one-off pieces. Once an original has been sold, it will no longer be available for purchase.
Prices & Payment
All prices are shown in pounds sterling (GBP).
Payment must be made using one of the payment methods available at checkout unless another arrangement has been agreed in advance.
Any delivery charges applicable to your order will be shown or agreed before the purchase is completed.
Original Artwork
Every original artwork is handmade and unique.
I make every effort to photograph and display artwork accurately. However, colours and appearance may vary slightly depending on lighting, photography and the screen or device used to view the website.
Dimensions and other information are provided as accurately as possible, but minor variations may occur due to the handmade nature of the work.
Fine Art Prints
Fine art prints are produced from my original artwork using high-quality materials.
Minor differences between a print and the original painting, or between the appearance of an image on screen and the physical print, may occur as a result of the printing process, paper and differences between displays.
Where a print is sold as a limited edition, the edition size will be stated in the product description.
Commissions
Commissioned artworks are created to the customer's individual specifications and are subject to separate Commission Terms agreed before work begins. These terms will set out the deposit, payment arrangements, cancellation terms, agreed subject and size, and any revisions included.
Because commissioned artworks are made to the customer's specifications and are bespoke or personalised, the statutory 14-day change-of-mind cancellation right that normally applies to distance purchases does not apply.
Cancellation of a commission after it has been agreed is subject to the separate Commission Terms. Deposits and other payments may be retained in accordance with those terms and applicable consumer law.
This does not affect your statutory rights where an artwork is faulty, not as described or otherwise does not conform to the contract.
Payment Plans
Payment plans are available on selected original artworks, allowing the purchase price to be spread over 2–4 monthly instalments at no additional charge.
Artwork purchased through a payment plan will be reserved and remain in the possession of Gabby Nind Art until payment has been received in full.
Payment plans are subject to the separate Payment Plan Terms, which explain payment schedules, cancellations, missed payments, refunds and delivery. By arranging a payment plan, you agree to those terms.
Payment plans do not affect your statutory consumer rights.

Copyright & Reproduction
All original artworks, prints, images and designs by Gabby Nind remain the intellectual property and copyright of Gabby Nind Art unless expressly agreed otherwise in writing.
Purchasing an original artwork or print gives the purchaser ownership of the physical item only. It does not transfer copyright, reproduction rights or any other intellectual property rights.
Artwork and images may not be copied, reproduced, distributed, published, altered, commercially exploited or used to create prints, merchandise, digital products or other derivative products without prior written permission.
Images of my artwork may not be used for the training, development or operation of artificial intelligence or generative AI systems, datasets or machine-learning models without my express written permission.
Unauthorised reproduction or commercial use of my artwork or images may constitute copyright infringement, and I reserve the right to take appropriate action to protect my intellectual property.
This does not prevent reasonable personal use of photographs of artwork you own, or uses otherwise permitted by law.

Images, artwork, text and other original content appearing on this website are owned by or licensed to Gabby Nind Art and may not be copied or commercially reproduced without permission.
Liability
Nothing in these Terms & Conditions excludes or limits any rights you have under UK consumer law or any liability that cannot legally be excluded.
Gabby Nind Art is not responsible for losses resulting from circumstances outside reasonable control.
Changes to These Terms
These Terms & Conditions may occasionally be updated to reflect changes to the website, the way the business operates or applicable legal requirements.
The terms that apply to your purchase will be those in effect when your order is placed.
Governing Law
These Terms & Conditions are governed by the laws of England and Wales.
Nothing in these terms affects any mandatory consumer rights you may have under applicable law.
