I want you to be completely happy with your artwork. Please read the information below regarding delivery, collection, cancellations and returns.
UK Delivery
Orders placed through this website are currently available for delivery within the United Kingdom.
Delivery costs will be shown at checkout or, where a specialist delivery service is required for an original artwork, agreed with you before dispatch.
Original artworks are carefully packaged to protect them during transit. Where appropriate, tracked and/or insured delivery services will be used.
Once your order has been dispatched, you will receive delivery or tracking information where available.
Dispatch Times
Original artworks will normally be dispatched within 3–5 working days, unless otherwise stated on the product page or agreed with you.
Fine art prints will normally be dispatched within 5–7 working days.
If there is likely to be a significant delay with your order, I will contact you.
International Orders
Online checkout is currently available for UK delivery only.
If you are outside the UK and would like to purchase an original artwork or print, please contact me before purchasing. I am happy to consider international delivery on an individual basis where a suitable shipping service can be arranged.
International customers are responsible for any applicable import duties, taxes, customs charges or other fees imposed in the destination country unless otherwise agreed.
Studio Collection
Free collection may be available by prior arrangement.
My studio is based near Ross-on-Wye, Herefordshire. For privacy and security, the full collection address is not published online and will be provided directly to customers after purchase when collection has been arranged.
Please do not travel to collect an artwork until a collection time has been confirmed.
Your Right to Cancel
For most standard products purchased online, you have a legal right to change your mind and cancel your purchase.
You may notify me that you wish to cancel at any time after placing your order and up to 14 days after the goods are delivered to you.
Please contact me by email within this period if you wish to cancel.
After notifying me that you wish to cancel, you then have 14 days to return the goods.
These cancellation rights do not apply to commissioned artworks or other goods made to your specifications or clearly personalised. Commissioned artworks are subject to separate Commission Terms.
Your statutory rights in relation to faulty, damaged or incorrectly described goods are not affected.
Change-of-Mind Returns
If you exercise your right to cancel a standard purchase, the item must be returned to me within 14 days of notifying me of your cancellation.
Please contact me before sending anything back so that I can provide the appropriate return instructions and return address.
Artwork and prints should be returned securely and, wherever reasonably possible, in their original protective packaging.
You are responsible for taking reasonable care of the item while it is in your possession.
For change-of-mind returns, you are responsible for the cost of returning the item to me.
I strongly recommend using an appropriately tracked and insured service when returning original artwork, as you are responsible for the item until it is returned to me.
Refunds for Change-of-Mind Returns
Where you validly exercise your right to cancel, I will refund the price you paid for the item together with the cost of the standard delivery option offered for your order.
If you chose a more expensive or enhanced delivery service, I am not required to refund the additional cost above the standard delivery option.
Refunds will normally be made using the same payment method used for the original purchase.
Refunds will be made within the time required by applicable consumer law. I may withhold the refund until the goods have been returned to me or you provide evidence that you have sent them back, whichever occurs first.
I may make a reasonable deduction from the refund if the value of the goods has been reduced as a result of handling beyond what would reasonably be necessary to inspect them.
Lost or Damaged in Transit
If your order is lost or arrives damaged in transit, please contact me as soon as possible with your order details.
For damaged deliveries, please retain the artwork and all original packaging. I may ask you to provide photographs of the artwork, packaging and any visible damage so that I can establish what has happened and raise a claim with the delivery provider where necessary.
I may need to make reasonable enquiries with the delivery provider to establish what has happened and to arrange an appropriate resolution.
Where an order is confirmed as lost or has been damaged in transit, I will provide an appropriate remedy in accordance with your statutory consumer rights. Depending on the circumstances and the nature of the item, this may include a repair, replacement or refund.
Any claim I make against a courier or insurer is separate from your statutory consumer rights and will not unreasonably delay any refund or other remedy to which you are entitled.
Faulty, Incorrect or Not as Described
If you receive an item that is faulty, incorrectly supplied or not as described, please contact me as soon as possible with your order details.
I may ask for photographs or other reasonable information to help establish the issue.
Where goods do not conform to the contract, I will provide an appropriate remedy in accordance with UK consumer law.
Where a return is reasonably required because goods are faulty, incorrectly supplied, damaged in transit or not as described, reasonable return costs will be covered by Gabby Nind Art.
Nothing in this policy affects your statutory consumer rights.
Commissioned Artwork
Commissioned artworks are created specifically to the customer's requirements and are therefore treated differently from standard products.
The statutory 14-day change-of-mind cancellation right does not apply to goods made to the customer's specifications or clearly personalised.
Commission purchases are governed by the separate Commission Terms agreed before the commission begins, including the terms relating to deposits and cancellation.
This does not affect your statutory rights if commissioned artwork is faulty, not as described or otherwise does not conform to the contract.
Payment Plan Purchases
Purchasing an eligible original artwork through a payment plan does not reduce your statutory consumer rights.
Cancellation of a payment plan before the artwork is delivered is governed by the separate Payment Plan Terms.
For eligible non-commissioned artwork purchased at a distance, you will also have the applicable statutory cancellation and return rights described on this page.
